This page presents the applicable General Terms and Conditions of Sale which condition the use and purchases made on the www.howifeel.ch website.
1. Field of application
The General Terms and Conditions of Sale (hereinafter the “GTCS”) apply to all legal deeds completed on the online shop www.howifeel.ch ou HIF (hereinafter the “online shop”).
The online store is managed by Didier Lamberet.
howifeel.ch reserves the right to alter these GTCS at any time. The version of the GTCS in force at the time of order is decisive and cannot be altered unilaterally for this order.
The product and services offer available at the online shop is exclusively intended for customers having an adress in Switzerland.
Deliveries are only made to addresses in Switzerland.
The offer is valid for as long as the product can be found on the online shop, with the help of the search feature, and while stocks last.
Product images featured in advertisements, brochures, the online shop, etc. serve for illustrative purposes only and are non-binding.
All sales prices published on the online shop are definitive and include VAT.
2. Availability and delivery times
howifeel.ch undertakes to process the order within 2 working days, as long as stocks are available. However, delivery times of 2 working days from dispatch are only indicative and may vary in the event of a delay by the carrier.
3. Completion of the contract
Products and prices published on the online shop are considered as offers.
Order reception is confirmed to the customer by means of an automatically generated order confirmation via email.
4. Delivery / collection at one of our branches
Deliveries are ensured by Planzer (Suisse) S.A.
Deposit in the parcel box:
If you allow your parcel to be dropped off in your parcel box, howifeel declines all responsibility for theft of the parcel. Our delivery person automatically records a proof of deposit with a photo.
To authorize the deposit, you just have to check the box "By checking this box, I authorize Planzer to leave my package in the parcel box if I am not there to receive it. " at the moment of the order validation.
If this box is not ticked, the delivery person is automatically not authorised to leave the parcel in the parcel box.
The delivery address must be in Switzerland.
Should the customer fail to reception the order at the agreed or indicated delivery date, howifeel.ch may terminate the contract and charge the customer for the delivery costs incurred.
5. Customer inspection
It is the customer’s responsibility to check the delivered product(s).
Any errors or damages must be reported to howifeel.ch within 5 working days. Otherwise, it will be assumed that the products were received in perfect condition.
The buyer must report apparent defects and hidden defects within 14 days of receipt of the products. Defective products, accompanied by a copy of the invoice and a detailed description of the defect(s), must be sent to howifeel.ch at the following address: howifeel.ch, 9 Rue Verdaine, 1204 Geneva.
The warranty becomes null and void in the event of improper use of the products.
Payment is made in advance by credit card via online payment services provided by PostFinance.
8. Changes to or cancellation of the order
Should delivery become impossible after the order or completion of the contract, the customer is immediately informed by email. If the order has already been paid for, the amount will be reimbursed.
9. Return of undamaged delivered goods
A right of return is granted within a maximum of 7 working days. Within this period, the customer must express his desire to return the products to howifeel.ch by email to the following address: email@example.com.
The customer must return the products to the address indicated on the delivery note at his own expense and risk.
The products must be sent with all accessories in the original packaging unopened, properly packed and with a copy of the invoice. Damaged products will not be taken back and will be invoiced to the customer in full.
howifeel.ch will refund the customer the full purchase price provided that the above conditions are met.
The reimbursement of the goods will be made once the product(s) received have been checked. After verification, howifeel.ch undertakes to reimburse within 14 calendar days.
Items on sale cannot be returned.
howifeel.ch is not responsible for the correct routing (loss, delays, destruction ...) during return transport.
10. Data Protection
howifeel.ch undertakes to respect Swiss legal provisions regarding data protection when processing the customer’s personal data.
All personal data will be considered as confidential. Information required for order management will be subject to computer processing and may be communicated to associated companies within the context of order management.
11. Jurisdiction and applicable law
The relationship between howifeel.ch and the customer is exclusively governed by Swiss law.
The parties accept the jurisdiction of the competent courts of the Canton of Vaud for the settlement of any dispute relating hereto, subject to possible appeal to the Federal Court.
